This policy explains everything you need to know before diving or booking with us β including safety requirements, booking rules, refund terms, equipment service warranties, and privacy protections.
By booking or using our services, you confirm that you have read and accepted all terms below.
β 1. FUN DIVING REQUIREMENTS
To ensure your safety and enjoyment:
Certification & Dive History
- Must be a certified diver (Open Water or higher)
- Must have at least 1 logged dive within the past 12 months
Site-Specific Dive Experience
- Koh Tachai & Richelieu Rock: Minimum 8 logged dives
- Seachart Wreck: Advanced Open Water + 50 logged dives
Health & Fitness
- Dive insurance is strongly recommended
- Must be medically fit and free of any serious conditions
- Doctorβs clearance may be required for specific conditions
Health & Medical Disclosure Policy
At X DIVE THAILAND, your safety is our top priority. To meet international dive safety standards and protect both you and our team, all divers are required to disclose their health status honestly before participating in any dive activity.
β What You Must Disclose
When booking online or in person, you must inform us if you:
1. Have ever been diagnosed with a heart, lung, or blood condition
2. Have asthma, epilepsy, diabetes, or other chronic illnesses
3. Have had recent surgery, injuries, or ongoing treatments
4 Take any regular medication (prescription or over-the-counter)
5. Have had issues with ears, sinuses, breathing, or pressure changes
6. You are pregnant, suspect you may be pregnant, or are trying to become pregnant.
Note: You donβt need to share full medical history β only what’s relevant to diving safety
π§Ύ Doctorβs Clearance Requirement
If any of the above applies, we may ask you to provide a signed medical clearance from a licensed doctor, confirming you are fit to dive.
1. Medical forms must be completed honestly and signed before joining
2. We follow DAN & RSTC guidelines for health screening
3. If you fail to provide a required medical clearance, you will not be allowed to dive, and your booking may be non-refundable
βFailure to Disclose = No Refund
If a diver withholds or misrepresents their medical condition:
1. We reserve the right to refuse participation without refund
2.This policy is in place to prevent accidents, emergency evacuations, and legal liability
Equipment Responsibility
- Divers are responsible for checking personal or rental gear before each dive
- Any damage, flooding, or loss due to negligence will be charged at full replacement cost
π 2. BOOKING & CANCELLATION POLICY
Booking & Payment
- 50% deposit required to confirm all bookings
- Full payment due before departure
- Bookings must be finalized by 12:00 PM (noon) the day before the trip
Cancellation Rules
- Cancel after 10:00 AM (1 day before) β 50% of deposit lost
- Cancel after 12:00 PM (1 day before) β 100% of deposit lost
- No refunds for no-shows, seasickness, or personal emergencies
Important: Refund rules apply strictly. No exceptions for delayed flights, personal events, or last-minute cancellations.
Weather & Safety
- Trips may be rescheduled or canceled for unsafe conditions
- If we cancel, youβll receive a full refund or option to reschedule
National Park Fees
- Must be paid in cash only (not included in trip price)
- Failure to pay may result in denied boarding, without refund
Late Arrival
- Divers who miss departure due to lateness forfeit their trip with no refund
β οΈ 3. SAFETY & CONDUCT
- Follow all dive leader instructions and safety rules
- No alcohol or drugs before or during diving
- Unsafe behavior may result in being removed from dives without refund
β 4. ADDITIONAL POLICIES
Dive Insurance
- Not required, but highly recommended
- Some dive sites are remote and lack nearby medical facilities
No-Fly Time
- Wait 18 hours after 1 dive
- Wait 24 hours after multiple/deep dives
- We are not responsible for missed flights due to ignored no-fly times
Minimum Group Size
- Trips may require a minimum number of divers
- If not met, we may reschedule or issue a full refund
ποΈ 5. PRODUCT RETURN & REFUND POLICY
Eligible for Return
- Must be unused, in original packaging, with all accessories
- Return request must be made within 14 days of delivery
Not Accepted
- Used, opened, or submerged products
- Hygiene-related items (e.g. snorkels, wetsuits, mouthpieces)
- Customized gear or digital products after download
Return Process
- Email info@xdive-thailand.com
- Follow return instructions provided
- Ship item within 7 days of approval
- Refund issued after inspection (within 14 business days)
Return Shipping
- We may cover valid returns
- You cover return costs for incorrect use or accidental damage
π οΈ 6. REGULATOR SERVICING TERMS & WARRANTY
We offer full servicing using genuine service kits and manufacturer procedures.
Whatβs Included
- Disassembly, ultrasonic cleaning, inspection
- Replacement of wear parts using our kits only
- Reassembly & performance testing
2-Months Limited Warranty
Valid only if:
- Full regulator set (1st stage, 2nd stage, octopus, inflator) is serviced
- Our service kits are used β no third-party or customer-supplied parts
- Gear is properly maintained and not tampered with
Not Covered
- Partial servicing
- Customer-supplied parts
- Flooding, impact damage, neglect, or unauthorized adjustment
Equipment Release
- Gear must be inspected and signed for on pickup
- Youβll sign a form confirming you accept the condition of the equipment
- After pickup, we are not liable for how the equipment is used
Unclaimed Equipment
- Items not picked up within 60 days of notification may be considered abandoned
- We reserve the right to dispose of or resell unclaimed items
π 7. LIABILITY & FINAL DECISION
By booking or diving with us, you agree to assume all normal risks associated with scuba diving. X Dive Thailand and its staff are not liable for injuries, accidents, or property loss unless caused by proven negligence.
We reserve the right to:
- Refuse service
- Cancel trips
- Remove unsafe or disruptive guests
All final decisions are made at the discretion of X Dive Thailand management.
π 8. PRIVACY POLICY
We respect your privacy. Hereβs how we handle your information:
What We Collect
- Full name, contact info, dive certification, medical declaration
- ID or passport number (if required by law)
- Emergency contact, invoice/payment details
Why We Collect It
- To process bookings and ensure diving safety
- To meet local regulations and national park rules
- To coordinate with tour partners (e.g. boat operators)
Who We Share It With
- Licensed tour providers and national park authorities
- Emergency services or insurance companies if needed
- We never sell or misuse your data
How We Protect It
- Stored securely with restricted staff access
- Deleted after use unless required by law (e.g. tax reporting)

- Request to view, correct, or delete your data at any time
